IMHCA wants our membership to be aware of new federal rules that outline the differences between 1099 positions and W2 positions. These are published by the US Department of Labor and serve to clarify these positions as outlined in the Fair Labor Standards Act. We are aware that both of these designations are often used for mental health providers in group practice settings, and want our members to have the most up to date information in determining if they are working as – or should hire others as – a 1099 Independent Contractor or a W2 Employee. This rule is set to go in place on March 11, 2024.
